Can I apply for a Spouse Visa UK?
You can apply for a Spouse Visa for the UK from any country of residence around the world, or the application can be made here in the UK. There are stringent requirements that must be met for any application to prove successful.
You will need to provide official documentation to validate your relationship. If you have been living outside of the UK, but with your spouse (who is a British Citizen) in another EU country, you could seek entry to the UK under EU regulations. This method is known as the Surinder Singh Visa route.
The Surinder Singh Immigration route is named after the first person who filed this type of case. If successful, this route permits for a 5-year residents’ card if applying in the UK, or a 6-month permit if applying from outside the UK.
What are Spouse Visa UK requirements and Spouse Visa financial requirements?
The minimum requirements for a UK Spouse Visa are largely the same for any type of UK Partner Visa.
UK Spouse Visa requirements involve:
- Proof of English Language ability
- Passing the genuine relationship test
- Evidence of having proper accommodation in place
- A minimum sponsor partner income of £18,600 per year.
If dependent children are part of the family unit then the minimum income threshold is subject to increase. This threshold is raised to £22,400 per year if there is one dependent child and is subject to incremental rises of £2,400 for every additional child.
The UK Home Office charges different rates for a UK Spouse Visa depending on if you are applying with dependent children as well.
It is also worth noting that since Aug 2017 decision on Spouse Visa application success pertaining to the income threshold must seek to consider alternative financing other than a regular salary. Considerations such as being able to financially sustain yourself without a job, whether you are planning to be self-employed or whether continued support (financially) may be provided by other family members.
What happens if my Spouse Visa is refused?
