Who will handle the conveyancing process?

What does conveyancing involve?

If you are happy with the quotation we outline for our services, we will ask you to provide proof of both your identity and your funds before we proceed with the conveyancing process:

Buying a property

  • The Energy Performance Certificate

We will obtain this from the seller’s solicitor so that we can begin to complete the legal work.

  • Review of seller information

We will thoroughly check all the paperwork provided by the seller’s solicitor, including the draft contract and the seller’s completed property information, which includes the fixtures and fittings list and will advise you of any issues.

  • Searches

Local searches are always required and look at matters relating to the property you are buying including planning permission, environmental health issues, proposals for nearby roads and highways and tree preservation orders.

Depending on the location of the property and your mortgage requirements, there are a number of other searches that may be carried out including water, environmental, railways, telecommunications, electricity and gas searches.

  • Planning permission and building regulations

If you are buying a house or any property that has been extended or altered in any way, we will ensure that all the correct permissions have been granted.

  • Mortgage offer

We will review the mortgage offer from your lender and consider any special instructions before exchanging contracts.

  • Survey

A survey is required by your lender so we will advise on the differences between a basic valuation, a home buyer’s report and valuation and a comprehensive building report.

  • Contract

Once you have signed the contract and a deposit has been received, exchange of contracts can take place and your purchase becomes legally binding.

  • Completion

The completion date is the day you can move into your new property. We will transfer the balance of the purchase price and will receive the title deeds, which we will then register with the Land Registry on your behalf.

 

Selling a property

  • Deeds and titles

Obtaining the deeds and title to your property is essential before we can proceed. If you have a mortgage, these will usually be with your lender.

  • Property information and contract

You will be required to complete both a Seller’s Property Information form and a Fixtures and Fittings form. It is essential that all the information provided is accurate as it forms part of the pre-contract information. We will then draft the contract and send all information to the buyer’s solicitor so that searches can be arranged. We will respond to any queries arising from these.

  • Exchange of contracts

Once you have signed the contract, your sale is legally binding and we can set a date for completion.

  • Completion

There is typically a gap of two weeks between the exchange of contracts and the completion date, which is when you must vacate the property. This allows for the final paperwork to be prepared and checked and to obtain a final mortgage statement from your lender and prepare our final invoice. When the sale is complete we will deduct all outstanding payments including mortgage, estate agents and conveyancing fees and pay the balance to you.

 

How do I remortgage my property?

If you are looking to remortgage your property or change your mortgage lender then we can help. We will check all relevant paperwork including your title deeds and your mortgage offer and will carry out any searches, which might be required by your new lender. We will prepare your mortgage deed and will check your new mortgage offer before agreeing to completion.

Am I eligible for Right To Buy?

You must have been a council tenant for two years to be eligible for right to buy (or five years before January 2005). If you believe you are eligible, contact us today and we will advise you on submitting an application.
